These Terms and Conditions of Sale apply to all orders placed by the customer on the Really Ugly Sweater website: www.reallyuglysweater.be. Please read our Terms and Conditions carefully before placing any order. By placing an order, you enter into an agreement with us and accept these Terms and Conditions of Sale.
The website www.reallyuglysweater.be and the brand Really Ugly Sweater are the property of and are managed by gents bvba, Rodelijvekensstraat 28/002, 9000 Ghent, which is the vendor of the products.
We recommend that you download our Terms and Conditions of Sale to keep a copy for your future reference.
RIGHT OF RETURN
Due to the nature of this product, returns are not possible.
These Terms and Conditions of Sale and all disputes arising in connection with these Terms and Conditions or with the use of the website or with any purchase made on the website shall be governed by Belgian law. We may modify or amend these Terms and Conditions of Sale at any time. Any changes made after you have placed an order shall not affect that order, unless we are required by law to apply the change retroactively. You are therefore being asked to accept only the Terms and Conditions of Sale that are applicable at the time of purchase with each of your orders.
OWNERSHIP OF RIGHTS
All rights remain with us and our subsidiaries. Any partial or total reproduction of this content, by any means and on any support, is prohibited without prior and express authorisation by us. The client undertakes not to paste or download the content of www.reallyuglysweater.be except with the prior and express authorization of us.
We reserve all intellectual property rights connected with any part of the website (including, entailing no limitation thereby, any graphic designs and codes used therein, its trademarks, trade names, denominations or slogans) or the products supplied to its customers, which may be covered by protection according to current intellectual property legislation.
PRICING POLICY AND CHARGES
All prices displayed in the Really Ugly Sweater online store include Belgian Value Added Tax (VAT) and the shipping fee.
HOW TO SHOP ONLINE
a. Submitting your order
Orders are placed on our site in the following steps:
You choose your products
You enter your data and specify your delivery address
The payment is done via Mollie
Mollie confirms the payment
The order is confirmed on the website and via e-mail
We receive your payment via Mollie
We ship the product(s)
We send you an e-mail with the shipping information
You receive the products
Before proceeding to payment, you can review your order and make changes as needed. You are bound by your order from the moment you accept the online offer on the Really Ugly Sweater website and the conditions thereby stipulated have been fullfilled (once the order has been submitted and payment confirmed on the website). Please note that the order shall not be valid if the Really Ugly Sweater website cannot confirm the shipping address that you provide. We also reserve the right to only accept orders from individuals over 18 years of age.
We only sell items that we have in stock. If garments should sell out during the shopping session, we will contact you. Please note that all prices and product information on www.reallyuglysweater.be are subject to change. Any erroneous prices mentioned on our site will be corrected as soon as possible and shall not be binding for us.
If your require an invoice for your purchase, please send us your billing information and the details of your order at email@example.com.
We accept payment by Mollie. For the transaction, you will be redirected offsite to the Mollie website, which is encrypted and 100% secure. Afterwards you will be redirected back to the Really Ugly Sweater shop to receive an order confirmation. You will be required to furnish payment details that you represent and warrant are both valid and correct and you must confirm that you are the person referred to in the information provided. We reserve the right to restrict multiple quantities of an item, or of orders, being shipped to any one customer or postal address.
c. Order confirmation
You will receive an immediate online confirmation on your screen at the end of the checkout process, as well as an e-mail confirmation of your order. This confirmation is completed upon sending the e-mail of the shipping process. We reserve the right not to confirm an order for any reason (technical issues, item unavailable, problem concerning the order received, abnormal order, wrong information provided by the purchaser, purchaser under age 18, unpredictable problems concerning the delivery or issues concerning a previous order). In this case, we will contact the client; please allow a maximum delay of 2 weeks once the order is registered and a refund will be made. If we are only able to fulfil part of your order, payment will be taken for your whole order, and upon shipping a full refund for the unavailable goods shall be made.
d. Changes to your placed order
Once your order has been placed and you have received an order confirmation e-mail, you may not make any changes to your order via the website. If you wish to make changes to your placed order, or if there is any mistake made in registering customer contact or address details when placing the order, it is your responsibility to contact us immediately and we’ll see what we can do.
Offers do not automatically apply for reorders.
DELIVERY AND SHIPPING
For all shippings outside of Belgium, e-mail us on firstname.lastname@example.org & we’ll send you an estimate of the shipping costs.
All orders placed before December 20 at 11 pm will be shipped on December 21. All orders placed after December 20 at 11 pm will be shipped on January 4. This delivery time is in no way a guarantee due to third party factors, which may cause delays. We are not responsible for any delays, thus in case of delays the purchaser does not have the right to cancel the order, refuse the products or claim a compensation. If a delivery cannot be shipped or only partially due to the goods not being in stock or for other reasons, the consumer shall be informed about this as quickly as possible or at the latest 30 days after the order was placed.
We shall not be liable for the acts of the courier companies that are used for making the delivery of the products at any time. If the parcel is damaged when it arrives, please contact us within 2 days and we will contact the courier company.

b. Uncollected packages
We shall not pay shipping for uncollected packages.
If, after the first attempted delivery, the products cannot be delivered in the following 7 working days and are returned to us, we shall assume that you will get in contact to pick-up your order.
COLOURS & IMAGES
We do our best to portray the Really Ugly Sweater as accurately as possible, but we cannot guarantee that the colours seen on screen will precisely match those of the product(s) received. The photographs of the product offered are for illustration purposes only and meant as a guideline, and thus may differ from the original.
The personal information you submit shall only be used in order to fulfil Really Ugly Sweater’s obligations and to assure you the best service. We shall not allow any third party to see or use your personal details without your prior consent. You have the right to see your personal details upon request. If the information is incomplete or incorrect, you have the right to have the information completed or corrected. You can always ask us to have your information deleted. If you wish to unsubscribe from our mailing list, please send an e-mail to firstname.lastname@example.org.
We undertake to handle and process all personal data that are furnished in accordance with the Belgian Privacy Protection Act of 8 December 1992.
The site uses so-called "traffic data", which entail the registration of an IP address*, the installation of a cookie** and the registration of the click behaviour and the analysis of the navigation on our website. These traffic data are used for purposes of statistical analysis. Information such as visitor numbers and visit frequency are used for internal research and in order to improve the website. However, this information is general in nature and cannot be traced back to any individual visitor. The data of the visitor(s) remain unknown.
These Terms and Conditions of Sale completely and exhaustively describe all of our obligations and liability with regard to the delivery of the Products. In so far as legally permitted, no other guarantees, conditions or other arrangements apply for the Vendor than those set forth in these Terms and Conditions.
We are not liable on the basis of non-performance, wrongful act or otherwise, for any economic loss (including, but not limited to, loss of income, lost profits and/or turnover or anticipated savings), loss of data, loss of goodwill or damage to reputation, or any other indirect, unforeseeable, special or consequential damage, however it may have arisen. However, nothing in these Terms and Conditions of Sale shall affect your rights on the basis of the law, and nothing in these Terms and Conditions of Sale is meant to exclude liability in the event of fraud or intentional fault.
Our Really Ugly Sweaters are made with the greatest care. However, we cannot be held liable for any damage - whether physical, material or immaterial - that should be the consequence of misuse of the product sold by Really Ugly Sweater and/or detached materials or accessories. The delivered articles possess the properties that you may expect under normal use on the basis of the contract. You may submit any complaints to us by e-mail. We shall not be liable if damage is attributable to intent and/or failure to comply with the washing instructions on the label of the articles.
